Repossession and Recovery
Our bailiffs act on your behalf to repossess equipment for unpaid leases, loans, or repairs.
Pursuant to the Personal Property Security Act, R.S.O. 1990 (PPSA) and the Repair and Storage Liens Act, R.S.O. 1990 (RSLA), bailiffs appointed by the Ministry of Government Services Consumer Protection Branch have legal authority to repossess equipment of any kind when the creditor has registered the appropriate lien.
Equipment as varied as office computers and furnishings through to industrial and heavy machinery can be the subject of a PPSA or RSLA lien. Whether the contract is a conditional sale agreement or a lease agreement, when a default in payments has occurred, the lien holder, or in the case of a lease, the owner, may wish to recover or repossess the equipment against which the lien is registered.
We have the experience and a network of reliable professionals to handle equipment recovery throughout our service area. Our bailiffs are dispatched promptly into the field, and our policy is to balance sensitivity to the debtor’s circumstances with the primary objective – recovery of the creditor’s collateral.
Our knowledgeable administrative staff also help maintain the high standards of professionalism that we first established in 1963, by tailoring our services to maximize cost-effectiveness while representing the creditor’s best interest. We also provide prompt reporting and updates to our clients during the recovery process.
Recovery alone is not enough. We are also extremely proud of our successful rate of redemptions.
When equipment is repossessed, the debtor might wish to get it back by redeeming the item from the creditor (paying the full amount owed) or reinstating the loan (getting current on payments).
Following the repossession, our administrative staff will immediately endeavour to work with the debtor and creditor to effect a recovery of arrears and/or loan payout (depending on the creditor’s instructions) as well as bailiff costs, to make the situation a win/win for both parties.
Not every file will redeem. In such instances we will prepare and serve all required notices and either liquidate the equipment for fair market value as quickly as possible or deliver the collateral to the liquidator of your choice.
